and lay faste moored in a convenient place in
the ryver of Thames a little above Ratcliffe
crosse, and whilst the Anthony lay there at an
anchor soe moored, a fflyeboate
(her name hee cannott expresse) came to an
anchor in the said river soe neere the Anthony
that shee could not take a cleere birth from the
Anthony, which they in the Anthony espieinge

Judge of his Majestyes high Court of the Admiraltye sayeth and
deposeth
That before Michaelmas last past (tempus aliter non mode recolit)
the shipp the Timothie of London (wherof Timothye Bugsbye was
master cominge from Newcastle loaden with Coales in company of
divers other shipps of London was surprized and taken by a Dunkirke
man of warr neere fflamborough head, which Dunkerke man of warr
tooke all the company of the Timothie out of her excepte this
xaminate and three more, and putt nyne of the Dunkirkers
aboard her, who after they had bene in possession of her three of
foure dayes beinge chaced by three Holland men of warr and in
great danger of beinge taken by them, broughte the sayd shipp
into Yarmouth roade, and tooke the Timomothyes boate and fledd

Thomas Morter of Ratcliffe Saylor aged about twenty yeares worne
before the worshipfull Mr Doctor Sames Surrogate to the right worshipfull
Sir Henry Marten knighte Judge of his Majestyes high Court of
the Admiraltye sayeth and deposeth
That the last sommer (the
tyme more certaynelye he remembreth not) this examinate
came from Newcastle in a shipp called the Pearle of London
(wherof William Bun is master) in company of a shipp called the
Timothy of London (wherof Timothy Bugby was master) and divers
other Colliers, and sayeth that neere fflamborough head there
came up a Dunkirke man of warr and surprized and tooke
the sayd shipp the Timothye and put men aboard her, and
not longe after the sayd Dunkerks brought the sayd shipp into Yarmouth
roade where this examinate and company in the Pearle came
in two or three houres before, and sayeth that the Dunkirks in the
Timothy hoysted out the Timothies boat and fledd on shoare at
Yarmouth, and that after the Dunkirks wer gone a shoare
there were about three men and a boy left aboard the sayd shipp the
Timothie who did belonge to the sayd shipp before her takinge
by the Dunkirks, and they beckoned and waved a
short flagge and a coate to this examinate and one more
of the company of the Pearle who stood upon the decke
to come aboard them, which they refused to doe not knoweinge

uppon certeine Interrogatories ministred on the behalfe of
John Powlson saieth as followeth:/
To the firste IInterrogatory he saieth That the
interrogate shipp the Susann was cast away on
Candlemas day Laste paste, at a place called
Arme neere Plymouth and sixe and twwenty of her
Company were then drowned and but five saved
wheof this examinate was one who was then
Masters Mate of that shippe/
To the 2d hee saith, That hee swam neere the
shoare, and then hee grewe soe weake that hee
could swim noe further and then Mr Poulson
rann into the water to him, and tooke him upp and
brought him to the shoare nad soe saved his lief
To the 3d hee saieth, That there were about forty
butts full of wyne saved by the said Mr Powlson
and by his meanes:/
To the 4th hee saieth, That this examinate and his
contest William Spencer being both Masters
Mates of the said shippe (because Mr Powlson
tould them that the Country people said hee
had noe authority to keepe them from spoiling
the said wynes) beeing out of all other hope
of the Recoveringe them did desire the said Mr
Powlson to indeavor to save those wynes
promiseing him satisfaccon for the saveing

from Tuesday to Saterday in the afternoone
draweing them with oxen and plowes from the
waterside to his house almost half a mile

deponit , That in the yeare 1625 the articulate shippe then
called the ffortune had bin imbargued at Mallega
in Spaine by the space of five monethes, order
came from the Kinge of Spaine that yf the
Englishe that had the dealeings for the Englishe shipps
then there imbargued would consente to the sale
of them, that then those Englishe shipps shoulde
bee there soulde , and there uppon by the consent of
this examinate who had the doeings for the said shippe
the ffortune and the Master of her (seeing their shippe
old and leakye and noe hopes to free her) gave their
consents to the sale of her and by their consents
the officers of the Kinge of Spaine proclaimed the
sale of that shippe, and this examinate caused certeine
ffrenchmen to buy that shippe of those officers
in their owne names but for the use of the articulate
William Carew the former Owbner of her, And
this hee affirmeth uppon his oath to bee true, Ac
aliter humoi articulos nescit deponere;/
Ad secundum affirmat, That yt was condiconed by and
betweene the said ffrenchmen and this examinate and Henery
Tayler the Master of her, that yf those frenchmen shoulde
buy the said shippe they shoulde have her to freighte
for a voyage from Mallega in Spaine to Sint Malloes
in ffrannce, and those ffrenchmen did promise to pay
to this examinate and the said Tayler for the use of the
said Carew 55s freighte for every tonn
of goods that should bee transported in that shippe
from Mallega to Saint Malloes deducting thereout the
monies which they paid for that shippe at Mallega yf the freight would extend to soe much, but yf not that Carew would pay the remainder And

Ad tertium affirmat, That after the premisses in the moneth
of May 1626 the said ffrenchmen which brought their
said shippe from the Spaniards, fully freighted
the said shippe at Mallega with wynes and fruite
for them selves exceptinge about tenn tonnes which
and Englishman lade into her and with those goods
the said shippe saileinge from Mallega towards
Saint Malloes, was in the said moneth of May laste
surprized and taken by certaine Turckishmen of
warr and carried to Algier, for that there was then
warres betweene the ffrench Kinge and the greate
Turcke and their subiects, And this hee affirmeth
uppon his oath to bee true who was taken in the said
shippe by the Turcks the tyme aforesaid, Ac

Ad quartum affirmat, That after their bringeinge to
Algier, the Turcks tooke all the goods out of her
ethe said shippe excepte aboute fifty
pipes of wyne, but that shippe and her tackle and
furniture all except the powder, the Turcks
restored to this examinate and the said Tayler for
the use of the said Carew the Owner of her, and
they gave them the said fifty butts or thereabouts
of wyne for the use of the Owner of that shipp
for the freighte of the reste of the said goods

Company of the articulate shippe the John the voyage articulate
and was shippt into her that voyage to saile to
Callice in ffrannce and to that place the Master said

of Thames a little above Lee Captaine Cooke
