In the long list of don't do-s, it does also say don't "Create a modified version of the Octocat or GitHub logo"; I'm assuming the two-tone mark is also considered a variant of the Octocat logo, however, i wonder if that would apply to creating a similar logo from the ground-up instead of modifying theirs. Not a lawyer, so just idle wondering...
Worst case would probably be to come up with a custom design that would communicate "Open Source" in some fashion.
We don't use Bitbucket anymore, but the icon used in the Open Source section in the homepage still has the Bitbucket logo.
