The ICO has changed the way it handles and accepts complaints in recent years, as a result of its efforts to clear the case backlog. This has involved triaging complaints using the complaints form. Our current guidance could be a lot clearer about what complaints the ICO is and is not now willing to accept, and the steps that the triage questions on the form will want you to have gone through first before allowing you to submit it.

This might include

  • Complaining about a non response to an internal review after 40 working days, not 20.
  • Needing to chase the authority for a response in the event that they have not responded at all.
