This PR adds the first version of AUP to our legal suite in order to be more precise in our Terms and Conditions under chapter regarding Misuse about the General Rules of the Internet.

I have made some comments on aup-previous, they obviously also apply on the aup itself :-).

I would add something along the lines of "determining whether the customer is in violation of the acceptable use policy is the sole digression of Exoscale". You mention that the examples are not exhaustive, so you should establish that we will have the last word in judging where grey cases fall. If you had another arbitrage mechanism in mind, you should mention that.

I also prefer these things to be written in a passive tense ("The Service cannot be used" vs "You cannot use the Service"), mais les gouts et les couleurs ne se discutent pas.

for example and including are the same thing.
I'd use for example, because you already used including but not limited to the sentence before.
Unless including refers to "child pornography", at which point you probably need a comma (or I'd shift it later in the line, so it's less confusing)

requests so the target either cannot respond to legitimate
traffic or responds so slowly that it becomes ineffective.

- Covert Usage. Distributing software that covertly gathers or transmits information about a user.

Nitpick: this item has no return after it :-)
